Lasting Power of Attorney

A Lasting Power of Attorney (LPA) is a legal document as specified by the Mental Capacity Act 2005 (England and Wales). Its purpose is to enable a person wishing to plan ahead for the future, to appoint someone they trust to make decisions on their behalf regarding property and financial affairs, health and welfare, or both.

There are two types of Lasting Power of Attorney:

1. Health and Welfare is focused on what happens to you in the event of incapacitation or serious illness. This will include dealing with aspects such as care, moving into a care home or provision of treatment.

2. Property and Financial is focused on what happens to your estate and assets in the event of incapacitation or serious illness. This will include dealing with aspects such as managing your money, settling and paying bills, selling or disposing of assets to raise money.

At Pittalis LLP we will advise and assist you with the creation of a Lasting Power of Attorney.

We understand that creating an LPA is an important decision for you and your family. We will work with you and your family to support you through the process and ensure the legal requirements are met in making the application for an LPA and most importantly, that your instructions are properly reflected in the LPA.

In some cases, it may be too late to create an LPA as the affected person is already incapacitated. This is more complex as we will need to establish that it is appropriate for another person, who has not already been appointed, to manage the affected person’s affairs. This will require the assistance of the Court and the process can take longer.
